What Are the Common Types of Notarial Acts?

Notarization is the official fraud-deterrent process that assures the parties of a transaction that a document is authentic and can be trusted. It is a three-part process, performed by a Notary Public, that includes of vetting, certifying and record-keeping. Notarizations are sometimes referred to as “notarial acts.”

Above all, notarization is the assurance by a duly appointed and impartial Notary Public that a document is authentic, that its signature is genuine, and that its signer acted without duress or intimidation, and intended the terms of the document to be in full force and effect.

  • Acknowledgments

    The most frequently completed is the certificate of acknowledgment. This acknowledgment certificate is attached to the document when the notary public confirms the identity of the signer by personally appearing before the notary public and the signer acknowledges being the signer of the document. Acknowledgments are usually used in powers of attorney, deeds, mortgages, and trusts.

  • Jurats

    A jurat is completed and attached to the document when a person signs a document and swears under oath or affirms that the contents of the said document are true and correct before the notary public. A jurat is worded as “subscribed and sworn to” and usually used in affidavits and depositions.

  • Copy certification

    Under the Laws of California, a notary public can only certify copies of powers of attorney and copies of his/her sequential journal, or portions of the journal, in response to a written request of the California Secretary of State or a subpoena or court order. As a Mobile Notary in Sonoma County, California, I certify copies of these documents at prescribed legal rates.
